Contract Terms and Conditions for the Provision of Accommodation on a Night by Night Basis

 

 
  1. Introduction
 
These are the terms and conditions that apply when you book and pay for a room with ipswichdigs.
 
We reserve the right to amend these terms and conditions at any time and you should therefore check them each time you make a booking.
 
The terms and conditions that apply to your booking will be those in place on the date that you make your booking.
 
The effective date of our Terms and Conditions is detailed at the end of the document.
 
 
  1. Definition of some Terms
We/Us/Our:      
an ipswichdigs website, property, accommodation or room
 
You/Your:          
the guest or prospective guest
The Parties to this Contract:   
This contract shall strictly be between ipswichdigs/Us (who are the owners and managers of the properties advertised on their website) and You a prospective guest.
 
Room:                 
a bedroom usually but not always allocated to for the duration of your stay (can be the room booked or and an alternative so designated by us. We may change your room during  your stay)
 
Property:           
a property owned or managed by ipswichdigs where rooms are available on a night by night basis with maximum room occupancy of one. We are set up to meet the needs the of the lone professional traveller and or person visiting Ipswich and it’s surrounding areas on business/doing research. Although other guest types may be considered, the occupancy of the other rooms and their compatibility will be considered first.
 
 
Proof of ID – Full ID & ID LITE:
guests are required to provide ipswichdigs with proof of their identity (ID).
The following can be used as ID; a passport, a driving licence, a recent government/local authority letter/bill or bank statement. Letters, bills and bank statements need to be under ninety days old.
At ipswichdigs we do not ask for copies of your Full ID online e.g. a full copy of your passport, as this is more information than we need. We only need enough information to confirm your ID.
ID LITE requirements online are defined below:
Passport; we only need to see the picture and the name. Block out all other information.
Driving licence; we only need to see the picture and the name. Block out all other information.
A government or local authority letter or bill: we only need to see your name and address. The document date must be visible to indicate that it is under ninety days old. Block out all other information.
A bank statement; we only need to see your name and address. The document date must be visible to indicate that it is under ninety days old. Block out all other information.
Hitherto in these Terms and Conditions a reference to ID LITE will strictly mean one of the documents defined in the requirements above, only displaying the limited information as defined the requirements above.
 
Refundable Deposit:   
this is primarily taken to ensure the availability of funds to cover any negative outcomes as defined, but not limited by, the terms & conditions of this contract e.g. the cost of any damages or additional exceptional cleaning. Other exceptional fees or in stay charges can also be applied to this deposit and are specified within this contract.
 
No-Show:          
a guest who fails to Check-In at any point during the nights they have booked
 
No-Show Room Charge:             
our right to keep the whole or any part of the Booked Room Fee should you No-Show
 
Late Show:        
a guest who arrives and completes Check-In on a night other than the first night of their booking
 
 Booked Room Fee:      
the cost of the room for the duration of the booked dates (this does not include the One-Off Room Cleaning Fee)
 
Breach of Contract Charge:       
our right to keep the whole or any part of the Booked Room Fee should you breach any Condition of this contract. The One-Off Room Cleaning Fee will be added to this charge if the breach of contract occurs post Check-In
 
Late Check Out Charge:
a charge levied by us if you fail to leave your room by 10 a.m.
 
Maximum Single Stay Duration:     
this is ninety nights but may be rolled over a further two times, at ninety nights per iteration, at our discretion.
 
 
  1. Before you can Book
 
You will be asked to confirm that you have read and have accepted these terms and conditions before you are able to use the ipswichdigs website to make a booking with us.
 
You will also need to confirm that the accommodation will not be your only or principal home i.e. your Main Residence.
 
A booking cannot be made using the ipswichdigs website unless you confirm that you have a Main Residence in the UK or if temporarily in the UK in another country.
 
Finally, as a part of the Booking Process, or at the very latest during the assisted Check-In Process, you will need to confirm your identity by providing us with an acceptable form of your ID LITE. (See Definition of some Terms for ID LITE requirements).
 
You can complete Check-In and our Guest Book online immediately after paying for your booking or at any point in time before your booking starts.
 
Our Guest Book has functionality to allow you to upload a digital image of your ID LITE and doing this will allow you to complete Self Check – In, see the clause Self-Check-In after 4 p.m.
 
Anyone making a booking online, not providing a copy of their ID LITE online or when they arrive cannot complete Check-In.
 
Any booking made online shall be immediately and by default void if there is any discrepancy between the name used during the booking i.e. the booked guest’s name, the name, address or picture on the ID LITE and the person presenting themselves as our guest at the property, as this is a prerequisite condition of this contract. Should a discrepancy of this type be established post Check-In, i.e. the person present at the property is not the person who made the booking or the booking was made fraudulently using false information or stolen/fake ID LITE, then this will again be a breach of a condition of this contract requiring the guest/person present to immediately vacate the property as defined by the conditions this contract.
 
We will not be liable for any costs or damages resulting from any delay or non-performance of our obligations under this contract if you fail to provide us with one form of your ID LITE or provide us with incorrect/false information.
 
 
  1. Booking and Paying for Your Room
 
To make a booking please follow the instructions on ipswichdigs.co.uk.
Same day booking deadline is nine pm.
You must be at least 18 years old to make a booking.
 
To make a booking with us you will need to pay for; the Booked Room Fee (the total cost of the room for the dates required), the One-Off Room Cleaning Fee, the Refundable Deposit at the time of making the booking.
 
You will normally pay online via PayPal or a credit/debit card. The expiry date of your debit/credit card must be later than the end of your stay.
 
In exceptional circumstances and with prior agreement between you and us, we may reserve a room for you allowing you to make all the necessary payments when you arrive at our property and prior to Check-In. If paying on arrival you may also pay with cash (with proof of identification).
 
We do not accept personal cheques.
 
We use the Stripe Payment Gateway and PayPal to process digital payments online. In house we use the iZettle card payment terminal.
 
Please check that the details of your booking are complete and accurate before you confirm your booking. We will not be liable for any delay or non-performance on our part if you provide us with incorrect/false information.
 
We will confirm our acceptance of your booking by sending you an email to the email address that you provide during the booking process. The contract between us for the provision of your room and, any additional services, products, food or drink added to your booking, will be formed when you receive this email confirmation from us.
 
This contract is conditional on us receiving the prerequisite satisfactory evidence your identity i.e. your ID LITE.
 
This contract is conditional on the correct nightly rates/prices being made available to you during the booking process. Should there, for any reason, be errors in the nightly rates/prices presented to you on our website and subsequently used by you to make your booking, we reserve the right to cancel your booking. You are welcome to re book the same dates at the correct rates. We will not be liable for any delay or non-performance of our obligations under this contract if we cancel the contract between us due to an error in booked nightly rates/prices.
 
If you think that there is a mistake in your booking or if you require any changes to a confirmed booking,  please contact us to discuss. For more information on cancellation, please see the clause; Cancellation.
 
 
  1. No-Shows and Late Shows
 
If you make a booking, do not cancel the booking then subsequently do not Check-In at any point during your booked dates you shall be classed as a No-Show. You will be refunded the One-Off Cleaning Fee and the Refundable Deposit. You will not be refunded the Booked Room Fee which we will keep as your No-Show Room Charge.
 
If you make a booking, do not contact us to amend your booking but subsequently complete a Check-In to stay any night after the first night of your booking you shall not be refunded the cost of the nights you failed to stay with us.
 
Refunds in respect of a notified amended arrival date will be handled as per the Clause; Shortening Your Current Booking & Length of Stay Discounts.
 
 
  1. Room Prices
 
Room prices at ipswichdigs are Per Room, Per Night. i.e. Nightly Room Rates.
 
A night is defined as starting at 4pm and ending at 10 am on the following day.
 
We adopt a static standard pricing structure throughout the year meaning prices do not change based on demand.
 
Using ipswichdigs.co.uk to Check Availability will give you a total price for the Room for the number of nights you’ve requested, this is purely your Booked Room Fee and includes any applicable length of stay discounts.
 
  1. Extra Services
 
Any Extra services that may be available will be displayed on our website. Payment for extra services can be made on the in house card terminal. For convenience Extra Services can be charged to the Refundable Deposit before the balance is returned to you post your stay, and you herby agree and authorise us to make such deductions when we deem necessary.
 
  1. Length of Stay Discounts Automatically Applied
 
Discount Rates are automatically calculated and applied online according to the length of your stay. Additionally, the discounts rates are available to view on a table on ipswichdigs.co.uk.
 
Discount Rates are automatically applied online while checking the availability of the dates you require and displayed on the Search Results Page. The Search Results Page will show which rooms are available to book and the net discounted price, if applicable, according to length of stay that you specified in your search.
 
 
  1. One-Off Room Cleaning Fee
 
A One-off Room Cleaning Fee is charged per booking. The One-off Room Cleaning Fee is automatically applied online while making your booking.
 
The One-off Room Cleaning Fee amount is the amount detailed online at the time of your booking.
 
The One-off Room Cleaning Fee will be included in the breakdown of costs detailed on your online Booking Form once you start the booking process and will also be detailed on your invoices.
 
 
  1. Refundable Deposit
 
A Refundable Deposit is charged per booking.
 
The Refundable Deposit is automatically applied to the cost breakdown online and is taken at the same time payment for the room is made.
 
The Refundable Deposit amount is the amount detailed online at the time of your booking.
 
If there are no damages, above and beyond normal wear and tear, and no requirement to carry out any exceptional additional cleaning, above and beyond what is acceptable and reasonable, then the full amount of the Refundable Deposit shall be returned to you post your stay with us, using the same payment channel you used to make the original payment for your stay.
 
You agree that deductions from your Refundable Deposit shall be made at our discretion for any damage to our property above and beyond normal wear and tear or for any damage to our neighbours property or other guests’ property. Additionally you agree that deductions shall also be made in order to cover the cost of any exceptional additional cleaning that is required post your stay in order to bring your room or the property back up to an acceptable standard / it’s condition pre your stay with us.
 
If you lose any of our keys issued to you at Check-In you agree that the cost of these shall be deducted from your Refundable Deposit. The costs to be recouped will include change of locks the cutting of extra keys and any associated labour costs to do the work required to replace the necessary locks and keys. If the sum required is greater than the Refundable Deposit you agree to pay any reasonable invoice we raise in respect of keys lost and associated costs incurred. Should you fail to pay these costs we reserve the right to pursue these costs in the courts. Interest on sums owed will also be pursued at the rate of 8% for personal debts and 8% plus the Bank of England base rate for business to business transactions/debts.
 
The amount of any deductions from your Refundable Deposit will communicated to you with your final invoice along with an explanation of why we have made those deductions.
 
If you choose to dispute any proposed deductions we will provide evidence of the costs we incurred to restore the condition of our property. Usually we will charge you an amount slightly less than the cost to us. The reason for this being two fold; we do not need or want to profit from the process of restoring the condition of our property and secondly we operate on the principle of treating guests fairly and proportionately and in pursuance of this would rather knowingly undercharge you for these costs rather than unwittingly overcharge you.
If you cause damage to our property, our neighbours property or other guests’ property, or are otherwise in breach any of these terms and conditions, we reserve the right to:
 
cancel your booking with immediate effect. Where appropriate, and with the assistance of police law enforcement authorities, eject you from our property;
 
demand the return of all keys issued to you;
 
restrict your access to our property;
 
remove your items from our property, disposing of such items (at no cost and no liability) to a local charity to the extent such items are not collected from us within 7 days of removal;
 
retain all sums paid by you;
 
refuse future bookings from you and/or refuse you entry or accommodation with any ipswichdigs managed property;
 
pursue the recovery of all costs related to any damage you cause to our property, neighbouring properties or other guests’ property;
 
We will not be liable for any refund or compensation in such circumstances.
 
 
  1. Recouping Exceptional Costs/Losses above the Refundable Deposit
 
In the event the Refundable Deposit is not sufficient to cover the costs of any damage/additional exceptional cleaning; we reserve the right and you hereby agree and authorise us to charge you, using the payment method you used to make the original booking, for any damage you cause to your room, our property, other guests’ property or neighbouring properties during your stay (including without limitation specialist cleaning) or for any items that are missing when you leave, i.e. to charge you in order to cover the cost of any work required or purchases required to restore the condition of our property, neighbouring properties or guests property to a level comparable to it’s condition before your stay. In the event we are not able to recoup our losses using the payment method you used to make the original booking, you agree that in the first instance we will contact you and submit an invoice to you directly for immediate payment. Should this fail you we will pursue such losses/costs in the courts. Interest on sums owed will also be pursued at the rate of 8% for personal debts and 8% plus the Bank of England base rate for business to business transactions/debts.
 
 
  1. Change of Room
 
Wherever possible ipswichdigs will endeavour to ensure that the room selected during the booking process is available for or throughout the duration of the booking.
 
We may change the room allocated to you for your stay wholly at our own discretion, for any reason, at any time before the booking has started or at any point during the booking.
 
You are free to cancel all or part of your booking if you are not satisfied with the alternative room/arrangements we make under this condition. If you choose to cancel your refund will be handled as defined in the terms of this contract, pre Check-In see the clause; Cancellation, post Check-In see the clause; Shortening Your Current Booking & Length of Stay Discounts.
 
 
  1. 0ur Rights of Free Access & Egress to/from Guests Rooms
 
We reserve the right to enter all rooms and bedrooms at a time that best suits our staff/contractors to perform property management, duty of care checks, cleaning, servicing , maintenance duties.
 
We reserve the right to withhold the performance of our obligations to you under the terms of this contact and require you to immediately vacate the room/our property if you refuse our staff/contractors, anyone else we so authorise or any regulatory/legal enforcement authorities free access/egress from any room/our property. Under these circumstances you will not be refunded the Booked Room Fee which will keep as your Breach of Contract Charge or the One-Off Cleaning Fee, as rooms/the property will still need to be cleaned. The Refundable Deposit will be processed in the standard way as laid out in the terms of this contract, see the clause; Refundable Deposit.
 
 
  1. Occupancy
 
The maximum room occupancy is one adult. You must not exceed the maximum occupancy for any bedroom that you are authorised to use during the duration of your booking.
 
Occupancy is not transferable. You must not resell or transfer your booking (or any part of it) nor advertise, market or otherwise offer any of our rooms/part of our property for use or sale either on its own or as part of a combined offer. We will not honour any bookings made in this way and do not accept any liability for doing so.
 
If we become aware that the status of occupancy is not as defined in our contract with you or has been transferred in any way;
 
  1. a) before the booking has begun, we reserve the right to cancel the booking. You will be refunded the One-Off Cleaning Fee and the Refundable Deposit. You will not be refunded the cost of the Booked Room Fee which will keep as your Breach of Contract Charge.
 
  1. b) at any time during the course of the booking; we reserve the right to withhold the performance of our obligations under this contract and require you to vacate the room/property immediately, when necessary we will request the help of the relevant police law enforcement authorities. No refund of the Booked Room Fee or the One-Off Cleaning Fee shall be made under such circumstances and the Refundable Deposit will be processed as per the terms laid out in this contract, see the clause; Refundable Deposit.
 
Under these circumstances, those who are occupying the room are fraudulently posing as a party to this contract i.e. you, the relevant police authorities shall be informed to the details of the fraud and the details of all parties involved shall be shared with the relevant law enforcement authorities.
 
We reserve the right to conduct checks on occupancy at any time and as frequently as we see appropriate.
 
 
  1. Failure to Check-In
 
You will be unable to Check-In if you fail to supply/complete any one of the following:
 
Supply/Confirm Personal Details
 
Complete our Guest Book
 
Provide a copy of your ID LITE
 
 
If you fail to complete Check-In as defined in this contract then you shall be deemed to have failed to meet the conditions of this contract and we will be unable to fulfil our obligations to you as set out in this contract.
 
No room will be made available to you due to your non-performance of your obligations under this contract.
 
There will be no legal duty for us to provide you with any service or accommodation and the booking will be deemed to be cancelled.
 
Under these circumstances you will be refunded the One-Off Cleaning Fee and the Refundable Deposit. You will not be refunded the Booked Room Fee which we will keep as your Failure to Check-In Charge.
 
We reserve the right to waive this condition solely at our discretion and on a case by case basis.
 
 
  1. Self-Check-In After 4pm
 
Rooms are available from 4pm on the booked arrival date.
 
The Self Check-In service is only available to you if you complete our online Guest Book with ID LITE. This can be completed on our website immediately after making and paying for a booking. It can also be completed any time prior to arrival by accessing the online Guest Book page on our website.
 
After a guest completes our Guest Book with ID LITE they will be provided with the access codes for the Main Door and for their room and can arrive at our property any time after 4pm on the first day of their booking.
 
 
  1. Assisted Check-In Before 9PM
 
Rooms are available from 4pm on the arrival date.
 
If you do not qualify for Self-Check-In i.e. you have not completed/supplied all three of the following online at ipswichdigs.co.uk you will need to ensure you arrive before nine pm in order to complete an Assisted Check-In with a member of our team and must complete/supply the following:

Complete our Guest Book
 
Provide a copy of your ID LITE
 
If you originally planned to arrive before 9pm but subsequently realise you are not able to do this you are required to complete the Guest Book and must include a digital copy of your ID LITE online using the ipswichdigs.co.uk website, prior to your arrival. Once these tasks are completed you will be supplied with the codes to complete Self Check-In.
 
 
  1. Check Out
 
You understand and agree that permission for you to use a bedroom, associated communal areas (and associated products and services) booked with ipswichdigs will expire on the last day of your booking. You further agree and commit to vacating the room on the last day of your booking. Whether this be the last day of your original booking, the last day as defined by an agreement between you and us to a pre-paid extension to your booking, or the last day as defined by an agreement between you and us to end your booking on a day sooner than originally booked.
 
Rooms must be vacated by 10 a.m. on the last day of your booking.
 
Failure to leave your room by 10 a.m. may result in a Late Check Out Charge.
The amount of the charge will depend on how many staff/contractors we will have to employ to ensure the room is ready for occupation by our next guest. The amount of the Late Check Out Charge is within reason at our own discretion. We may at our own discretion choose to waive the Late Check Out Charge but reserve the right to implement this condition in our contract with you should we so choose. You herby agree and authorise us to deduct the Late Check Out Charge from you Refundable Deposit.
 
 
  1. Extending the Current Booking
 
Extensions to your Current Booking need to be agreed with us prior to you booking any additional available dates online.
 
We reserve the right to refuse your request for an extension to your current booking.
 
Furthermore, we reserve the right to void an extension to your current booking if made by you online using our ipswichdigs.co.uk website without prior agreement from us.
 
Should you wish to extend your stay beyond the last day of your current booking you should contact us as soon as possible. Any extension will be subject to availability. Even if an extension is possible, we cannot guarantee that you will be able to stay in the same room. If an extension takes your stay with us beyond the maximum single stay duration of 90 nights then an extension will not be possible, unless expressly agreed with us and is solely at our own discretion. A single stay may only be iterated a further two times at ninety nights per iteration.
 
 
  1. Extending Your Current Booking & Length of Stay Discounts
 
Discounts apply strictly to the dates booked in the first instance. Any unauthorised/unapproved Occupancy Before or Beyond the booked dates confirmed in your Booking Confirmation e-mail shall be charged at the Standard Rates as detailed on ipswichdigs.co.uk.
 
We may choose to waive this condition and can do so solely at our own discretion.
 
Otherwise nights stayed where no payments for those nights has already been made become immediately payable on our website. If no payment is immediately made, we reserve the right to eject you from our property with the assistance of the relevant police law enforcement authorities. Furthermore, we shall pursue all outstanding amounts in the courts. Interest on sums owed will also be pursued at the rate of 8% for personal debts and 8% plus the Bank of England base rate for business to business transactions/debts.
 
Where an extension to a current booking has been requested and approved you must use ipswichdigs.co.uk to book and pay for the additional dates required. This must be completed before the extended booking begins. The prices for the extension are those quoted on ipswichdigs.co.uk at the time of extending your booking.
 
 
  1. Shortening Your Current Booking & Length of Stay Discounts
 
If you make a booking, then subsequently contact us to agree a reduction in the length of your booking you shall receive a refund for the number of nights the booking is reduced. In calculating your refund we may make a deduction from the refund with regard to any Length of Stay Discounts automatically applied to the original booking if the new shorter booking does not qualify for the discounts originally given. You have this option both before and after Check-In.
 
 
  1. Exceptional Additional Cleaning Fee
 
You agree to keep the room allocated to you and any common areas that you use in a reasonable, clean, hygienic and tidy state.
 
In the event that you leave any part of our property in an exceptionally unhygienic, dirty or poor condition, we reserve the right to charge you for the excessive cleaning costs at a rate which is a fair and proportionate. This is the Exceptional Additional Cleaning Fee. You hereby agree and authorise us to deduct the Exceptional Additional Cleaning Fee from your Refundable Deposit. This will only be charged when absolutely necessary and as a last resort. This will be taken from the Refundable Deposit before the balance is returned to you. You will be informed of any deductions made from the Refundable Deposit when you receive your final Invoice.
 
 
  1. Special requests
 
Although we will try to accommodate special requests, all rooms are subject to availability/operational priorities.
 
 
  1. Cancellation
 
24.1 Your right to cancel
 
A guest who makes a booking, and then cancels before 4 p.m. on the booking start date shall be refunded the full cost of the booking.
 
Post Check-In, cancelling the remainder of your booking shall be handled according to the Clause: Shortening Your Current Booking & Length of Stay Discounts.
 
24.2 Our Right to Cancel
 
24.2.1 Your Breach
 
We may cancel your booking at any time with immediate effect by giving you written notice (which includes email) well in advance of arrival or verbal notice followed by written confirmation of said notice shortly before/at/after arrival if:
 
You fail to provide us with a copy of your ID LITE either online or when you arrive, therefore making it impossible for you to complete Check-In.
 
You break a Condition or Term of this contract between you and us in any way.
 
If this is prior to Check – In; You will be refunded the One-Off Cleaning Fee and the Refundable Deposit. You will not be refunded the Booked Room Fee which will keep as your Breach of Contract Charge.
 
If this is post Check-In; You will not be refunded the One-Off Cleaning Fee and the Refundable Deposit will be processed as per the standard terms of this contract. You will not be refunded the Booked Room Fee which will keep as your Breach of Contract Charge.
 
We reserve the right to decline or cancel bookings made and stays in progress by those who have previously breached these terms and conditions (or as may be updated from time to time), whether the booking is in that name or not.
 
24.2.2 Events Outside our Control
 
We may also cancel your booking if any event outside of our control (for example but not limited to; industrial action, explosion, outbreak of disease, health and safety issues, fire, flooding, and failure of power and/or water supplies or emergency evacuation) means that we are unable to make your room available to you. If this is prior to Check-In, we will contact you to let you know as soon as possible.
 
We would when possible, attempt to find you alternative local accommodation. Where this is not possible or acceptable to you, we will refund your payment to you via the payment method you used to make your original booking in either of the following ways;
 
Prior to Check-In; You will be refunded the One-Off Cleaning Fee the Refundable Deposit and your Booked Room Fee.
 
Post Check-In; You will not be refunded the One-Off Cleaning Fee and the Refundable Deposit will be processed as per the standard terms of this contract. You will only be refunded for the nights you were unable to stay with us pro rata the Booked Room Fee and in line with the terms in this contract see the clause; Shortening Your Current Booking & Length of Stay Discounts.
 
Save as set out above, we will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by an event outside of our control. This does not affect your statutory rights.
 
 
  1. Change of Bed Linen, Towels and Room Cleaning for Longer Bookings
 
Bed linen & towel changes and additional room cleaning will not normally be carried out for bookings of seven nights or less.
 
As we employ no onsite service providers on occasions it may be necessary for us to provide this service a day or two earlier or later so as to fit in with other servicing work that needs to be completed at the same time at the property.
 
You may request for this service to be moved to another day or even skipped outright but you have no right under the terms of this contract to insist on either. We can at our own discretion change the dates or skip the provision of this service.
 
Examples
 
If a guest has a booking of sixteen nights then we would normally arrange for bed linen & towel changes and room cleaning to take place on day eight.
 
If a guest has a booking of twenty nights then we would normally arrange for bed linen & towel changes and room cleaning to take place on day ten.
 
There is normally no charge for these services. For exceptions to this see the clause; Exceptional Additional Cleaning Fee.
 
 
  1. Spare Bed Linen and Towels
 
Each Bedroom has an extra set of clean Bed Linen and Towels in the bedroom cupboard. You are welcome to use these at will during your booking.
 
You are free to wash, dry and re-use the bed linen/towels from your room.
We have for sale Single Wash Pouches stored in the lockable bathroom cupboard allocated to each room.
During your stay you may pay for any Single Wash Pouches using the in house card terminal. If you choose not to pay during your stay, you herby agree and authorise us to charge the amounts due for all Single Wash Pouches that you have used to your Refundable Deposit.
 
 
  1. Free Tea Coffee and Condiments
 
Each room has an supply of free tea coffee and milk sticks in their allocated lockable kitchen cupboard.
Free butter and condiments are available in the lockable fridge/freezer.
 
  1. Breakfast and Snacks
 
We stock have for sale a small selection of breakfast items/drinks/snacks stored in the lockable kitchen cupboards and lockable fridge/freezer.
During your stay you may pay for food and drink items using the in house card terminal. If you choose not to pay during your stay, you herby agree and authorise us to charge the amounts due for food and drinks you have consumed to your Refundable Deposit.
You agree to keep your lockable cupboards locked when not in use. If you fail to do so and others consume the food/drinks in your cupboard you agree that you will pay for all items consumed irrespective of who consumed them or the circumstances under which they were taken and consumed. You agree that you are solely accountable for the food in your cupboards and you herby agree and authorise us to charge the amounts due for food and drinks consumed from your lockable cupboard to your Refundable Deposit.
  1. Quality Frozen Meals for One
 
Each freezer will have a small selection of pizzas and frozen meals for one.
During your stay you may pay for frozen pizzas or meals using the in house card terminal. If you choose not to pay during your stay, you herby agree and authorise us to charge the amounts due for pizzas and meals you have consumed to your Refundable Deposit.
You agree to keep your lockable fridge freezer locked when not in use. If you fail to do so and others consume the food/drinks in your fridge freezer you agree that you will pay for all items consumed irrespective of who consumed them or the circumstances under which they were taken and consumed. You agree that you are solely accountable for the food in your fridge freezer and you herby agree and authorise us to charge the amounts due for food and drinks consumed from your lockable fridge freezer to your Refundable Deposit.
 
  1. Food Allergies
 
If you have any allergies you are herby directed to check the product ingredients and decide for yourself if you are happy to rely description of the ingredients provided by the food manufacturer, just as you would when making a purchase in a supermarket.
 
If you are unsure if our food offerings ingredients are a danger to you caused by your allergies we direct you to purchase food elsewhere or prepare your own.
 
We shall not be held liable for type of injury/damage sustained by you for any failure of third party suppliers to properly list the ingredients of their products.
 
As we store and offer for sale food pre packaged by our supplier it is down to you to decide whether or not to prepare & consume these products and you do so at your own risk as you would when selecting safe food for yourself in a retail store. Any liability for mislabelling would be strictly between you and our supplier.
 
 
  1. Cooking Facilities
You agree that you will use the cooking facilities at times and in a manner which is considerate of other guests.
 
You agree that when you use the cooking facilities you will have regard to the needs/wishes of other users.
 
You agree that you will only prepare and cook the food in the kitchen area allocated for that purpose and in no other part of our property.
 
You agree that after you have finished cooking you will clean the kitchen, the cooker and other shared kitchen equipment that you have used. The cleaning of the larger items mentioned here need only be to a level that makes them acceptable for others to use, and in no way requires a deep clean.
 
Each room/guest is assigned their own lockable kitchen cupboards and lockable fridge freezer that are clearly marked with their room number.
 
Each room has its own cooking utensils/accessories & plates/cups/mugs inside an assigned kitchen cupboard. You agree that after you have finished cooking/eating that you will clean all the accessories that you have used and return them back into your cupboard and lock it. Should you leave your kitchen cupboard unlocked, and others use and do not clean items from your cupboard, you agree that you will clean these and return them back into your cupboard and lock it.
 
You agree that you are solely responsible for the clean return of all of your assigned cooking/eating accessories into your assigned kitchen cupboards.
 
 
  1. Bathroom, Showering and Toilet Facilities
 
You agree that you will not leave the bathroom, shower or toilet facilities in an exceptionally unhygienic dirty or poor condition.
 
Shampoo, Conditioner and Body Wash are all free and available through the wall mounted dispensers.
 
Each room/guest is assigned their own lockable bathroom cupboard which is clearly marked with their room number.
Each bathroom cupboard will have for sale a small supply of our One Wash Pouches for use in our washing machine. Each pouch contains a gel laundry capsule, a colour catcher sheet, a limescale preventer tablet and a 50ml bottle of fabric conditioner.
The One Wash Pouches can be paid for using the in house card terminal. If you choose not to pay during your stay, you herby agree and authorise us to charge the amounts due for One Wash Pouches used to your Refundable Deposit.
You agree to keep your lockable bathroom cupboard locked when not in use. If you fail to do so and others use the One Wash Pouches from your cupboard you agree that you will pay for all items used irrespective of who used them or the circumstances under which they were taken and used. You are accountable for the One Wash Pouches in your bathroom cupboard and you herby agree and authorise us to charge the amounts due for One Wash Pouches taken and used from your lockable bathroom cupboard to your Refundable Deposit.
 
You are free to leave your personal items in your bathroom cupboard for the duration of your stay, keeping it locked when you are not using it yourself.
No liability will exist on our part if your personal items are used/taken by others where you have not locked them away in the lockable cupboards assigned to you.
 
 
  1. Fixtures and Fittings
You agree that you will not add to, change, or in any other way interfere with the electrical cables, switches, junctions or points or the pipes, taps or other apparatus installed in connection with the supply or use of electricity, hot or cold water or gas, the internet cable installation, the CCTV/Security Systems or with any other furniture fixture or fittings (including curtains/blinds) in the property.
 
We reserve the right to recover from you the full cost of repairs arising out of unauthorised alterations to any part of our property;
You must report immediately to us any damage or fair wear and tear in your room/the property and the matter will be dealt with as soon as possible.
 
 
  1. Electrical and Other Apparatus
We are mindful of the impact that electrical items can have on the environment, and also the potential hazards electrical and/or battery-operated products can have in the properties we provide.
You are entitled to use our electricity for reasonable purposes, such as charging appliances. The use of high-power voltage items such as electric heaters is strictly forbidden and will constitute a breach of this contact, unless previously and exceptionally agreed with us prior to their use.
 
You agree that you will ensure that electrical equipment in your room is unplugged and switched off when your room is not occupied.
 
You agree that you will not bring on the property or use electrical extension cables of any kind at any time, it is strictly forbidden.
 
 
  1. Security Arrangements – CCTV Equipment – Video and Audio Recording 
You agree that you will ensure that the front door and back door is properly locked after you egress the property.
 
If at any time you use the garden, you agree that you will ensure that the garden door is properly locked after go back inside.
 
You agree that you will not interfere with any of the security equipment or associated infrastructure thereof located inside and outside the property.
 
You agree that you will ensure that your room door, the lockable fridge freezer, lockable kitchen & bathroom cupboards, which are all marked with your room number, are kept locked at all times when not in use.
 
You agree that we will not accept any responsibility for negative outcomes resulting from your failure lock away your personal items using the lockable storage facilities made available to you for the duration of your stay.
 
Recording CCTV installed on the outside of our property. The scope of view of this equipment is restricted up to the perimeter of our property. You understand and herby give consent to all recordings of your activities in the outside areas of our property. You can request copies of any recordings that include you by contacting us directly.
 
Indoor CCTV cameras are installed in the communal areas of the house but only active when the house is empty. While there are guests in the house the indoor cameras are remotely turned into the corner and their power supply remotely shut off. There is no live monitoring or recording of guests made with the internal cctv equipment. The status of the indoor cctv equipment can be viewed on the house tablet as can their power usage history.
 
In the event of  an ongoing breach of UK Law or a breach of a Condition of this contract you herby agree and consent to our making video and or audio recordings using our indoor/outdoor CCTV equipment or any other device so that we may gather audio and or video evidence of the ongoing incident for use by us or the UK Law Enforcement authorities in any legal action we/they may choose or are forced to take as a result of your breaches of UK Law or Conditions of this contract. You also agree that we may share this information with any online platform you used to make the booking e.g. Booking.com or Airbnb.
 
 
  1. Fire Safety
You agree that you will acquaint yourself with the fire and safety precautions, the fire safety equipment/locations, the fire escape evacuation routes, the location of fire exits and the assembly point; if in any doubt, please contact us directly.
 
You agree to vacate the property immediately whenever the fire alarm is sounded.
You agree that tampering with fire prevention/life-saving equipment such as, but not restricted to, fire extinguishers, fire doors and smoke detectors, is a criminal offence (punishable by a fine and/or imprisonment) and it will be treated as a breach of this contract with all offences being reported directly to the relevant law enforcement authorities.
 
 
  1. First Aid Equipment
 
You agree that you will not interfere with any of the First Aid Equipment or associated infrastructure thereof located inside the property.
 
You agree to inform us with the details of any First Aid Equipment that you use during your stay so that we may immediately replenish items used.
 
 
  1. Contagious or Infectious Diseases
 
If you are in contact with or contract any contagious or infectious diseases before or during the course of your stay you should report such a fact to us immediately. Unless it has been previously agreed with us, we reserve the right to cancel any bookings (before or during the stay) to the extent it is for self-isolation.
 
 
  1. Parking
 
There is free parking in parking bays on Little’s Crescent opposite our property. Should you use these bays you agree that you have parked your vehicle in these bays at your own risk, we accept no liability for any negative outcomes.
 
You agree that you will not park your vehicle in the bays at the top of Little’s Crescent (past number 44) as this is private land/parking.
 
 
  1. Visitors or Guest’s of Guests
 
Visitors or guest’s of guests are not permitted on our property at any time.
We reserve the right to withhold the performance of our obligations to you under the conditions of this contact and require you to immediately vacate the room/our property if you permit/allow any one else on to our property. The exception to this condition being people we have authorised for access or any regulatory/legal enforcement authorities. Under these circumstances you will not be refunded the Booked Room Fee which will keep as your Breach of Contract Charge or the One-Off Cleaning Fee, as rooms/the property will still need to be cleaned. The Refundable Deposit will be processed in the standard way as laid out in the terms of this contract, see the clause; Refundable Deposit.
Contrary to your agreement to this contract Should you allow visitors our property you agree that you will be responsible for the conduct of your visitors and the costs of any damage they cause while visiting you at our property. In the first instance you agree and authorise us to charge to your Refundable Deposit for any damage caused by your guest. Should these costs be greater than your Refundable Deposit we will initially raise and invoice with you directly for immediate payment. Should this fail we will pursue any outstanding sums for these costs in the courts. Interest on sums owed will also be pursued at the rate of 8% for personal debts and 8% plus the Bank of England base rate for business to business transactions/debts.
 
 
  1. Unacceptable Prohibited Behaviour
 
The following is not an exhaustive or exclusive list.
 
You agree that you shall not:
 
41.1 – while making the booking provide information that is misleading or fraudulent;
 
41.2 – engage in any criminal activity while staying in our property;
 
41.3 – bring on to the property or use drugs or psychoactive substances, the possession or use of which is prohibited by law (including but not limited to the Misuse of Drugs Act 1971 or the Psychoactive Substances Act 2016);
41.4 – keep or use any firearms, knives (other than kitchen knives), or any other weapons;
41.5 – engage in any act that will likely cause any health and safety hazard to any of our staff, contractors, any of our guests, our property, our neighbours property or our neighbours themselves;
 
41.6 – utilise our rooms to store items (personal or otherwise) which could in, our sole opinion, cause damage to any of our staff, contractors, any of our guests, our property, our neighbours property or our neighbours themselves;
 
41.7 – prevent our management, housekeeping, maintenance staff/contractors, or anyone else we so authorise from accessing your/any of our rooms as and when required by us;
 
41.8 – behave in a manner which is aggressive or abusive to any other person you come in to contact with while in/on our property;
 
41.9 – harass, threaten or assault any other guest, our employees/contractors or any other person while in/on our property;
 
41.10 – smoke anywhere inside the property. This includes the smoking of e-cigarettes. Smoking is permitted outside the property namely in the front or back garden, with cigarette stubs safely disposed of in Cigarette Wall Bins Provided. Smoking inside the property will result in a £100 fine deducted from the Refundable Deposit and you herby agree and authorise us to make this charge as when we believe it reasonable and appropriate to do so.
 
41.11 – engage in any activity which may set off the fire alarm system, excluding any normal cooking activities in the kitchen;
 
41.12 – bring any pets onto our property, with the exception of assistance dogs;
 
41.13 – tamper with any fire alarms or emergency equipment;
 
41.14 – tamper with any Security equipment;
 
41.15 – tamper with any Internet Equipment;
 
41.16 – remove, vandalise, damage or destroy any of our property;
 
41.17 – use any of the technology provided by us to download or access any unlawful or obscene material or to upload or share the same;
 
41.18 – cause unreasonable disturbance/nuisance to our other guests, any our staff/contractors or immediate the neighbouring properties;
 
41.19 – leave your allotted room in an exceptionally unhygienic dirty or poor condition;
 
41.20 – leave any items you use in the communal areas, namely but not exclusively the kitchen, lounge, dining room, bathroom or back garden in an exceptionally unhygienic dirty or poor condition. Any items you use in these areas need to be left in the condition they were in before you used them. You are not expected to deep clean larger items like baths, ovens or washing machines after normal use. Where an item/area used by a guest needs Exceptional Additional Cleaning we reserve the right to make a charge against the Refundable Deposit to have the item/area cleaned to an acceptable reasonable condition.

  1. The Contract
 
This contract formed when we confirm your booking between you and us, but is strictly only enforceable where you wholly satisfied specific contractual conditions at the time of making the booking.
 
No other person shall have any rights to enforce any of its terms, whether under the Contracts (Rights of Third Parties Act) 1999 or otherwise.
 
 
  1. Your rights
 
If you are a non-business customer you have certain rights under consumer protection legislation. Nothing in these terms and conditions is intended to affect those rights.
 
 
  1. Our liability
 
We accept liability for death and personal injury arising from our negligence or that of our employees and contractors. We do not seek to exclude our liability for fraudulent misrepresentation by us or our employees or contractors.
 
We do not accept liability for failure to meet any of our obligations where such failure is due to events beyond our reasonable control, see the clause; Events Outside our Control.
 
If we breach these terms and conditions for reasons within our control we shall only be liable for losses that are direct losses and are reasonably foreseeable consequences of such a breach, i.e. one off transport costs to alternative accommodation and additional costs for accommodation above and beyond those paid to us.
 
Save as prohibited by applicable law, we shall not be liable whether in contract, tort (including negligence) or for breach of statutory duty, or in any other way, for any indirect or consequential losses including but not limited to:
 
loss of income, sales or revenue;
 
loss of business;
 
business interruption;
 
loss of profits or contracts;
 
loss of anticipated savings;
 
loss of data;
 
losses related to increased time/costs related to commuting from alternative less convenient accommodation;
 
loss of reputation and/or goodwill; or
 
wasted management or office time.
 
Where we are liable to you (save as prohibited by applicable law) our maximum liability to you whether in contract, tort (including negligence) or for breach of statutory duty shall in no event exceed the price of your Booked Room Fee paid to us.
 
 
  1. Applicable law
 
These terms and conditions, your subject matter and formation (and any non-contractual disputes or claims) are governed by and construed in accordance with English law.
 
If you are a consumer you and we both agree that the courts of England and Wales will have non-exclusive jurisdiction over any claim arising from, or related to, your booking and/or stay with us. We retain the right to bring proceedings against you for breach of these terms and conditions in your country of residence or any other relevant country. If you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.
 
If you are making a business booking, you and we agree that the courts of England and Wales will have exclusive jurisdiction over any claim arising from, or related to your booking and/or stay with us.
 
 
  1. Severability
 
If any part of these terms and conditions is deemed invalid, illegal or for any reason unenforceable then that part will be deemed deleted and will not affect the validity and enforceability of the remaining parts. Any failure by us to enforce our rights or remedies under these terms and conditions or otherwise shall not be construed as a waiver by us of those or any other rights or remedies.
 
All/any of our rights not expressly granted in these terms and conditions are reserved.
